The Election Petitions Tribunal sitting in Ogun State, on Friday nullified the election of the Senator representing Ogun East Senatorial Constituency, Senator Buruji Kashamu.
The Tribunal also sacked Hon Adekoya Adesegun of the Ijebu East/ Ijebu North/ Ogun Waterside Federal Constituency and five members of the state House of Assembly for non-compliance with electoral laws.
The tribunal ordered fresh elections in the areas concerned.
The Chairman of the tribunal had pointed out that the documents filed by Prince Dapo Abiodun, the petitioner in the Ogun East senatorial election were admitted while those tendered by Prince Kashamu’s Omo Ilu Foundation were described as “irrelevant and annoying to bring to court”.
While delivering the ruling, the tribunal held that “on the issue of disqualification, indictment of respondent has no relevance to the tribunal. No matter how we feel about drug trafficking, we have no business with that. Corrupt practices could also not be proven. There was no linkage with the respondent.”
The tribunal also held that the petitioner did not show how unaccounted for votes affected the election.
“On the issue of over-voting, petitioner did not tender all the voters registers in the nine local government areas, only six were tendered. The margin between lawful votes is 5, 179 votes in favour of the respondent”, the tribunal ruled.
As it stands, the total number of votes upheld amounted to 146, 533 with 75, 856 in facour of the respondent while the petitioner had 70, 677 votes.
These will be added to the result of the local government areas where fresh elections would be held to determine the winnner.
