Chioma Okoli was granted N5 million in bail with two sureties in the same amount by Justice Peter Lifu of the Federal High Court, Abuja.
The allegations against Okoli stemmed from the remarks she made online about tomato paste made by Erisco Foods Limited.
Justice Lifu admitted her to bond but stipulated that one of the sureties had to be a blood relative or the defendant's spouse who lived within the court's jurisdiction and had a varied source of income.
In addition to directing the defendant to present her foreign passport, if any, the judge also ordered the sureties to deposit passport photos for each of them.
Judge Lifu accepted the lawyer's contention that Okoli was charged with a crime that qualified for bail.
Justice Lifu additionally declared that the defendant is presumed innocent unless and until proven guilty in accordance with Section 36(5) of the 1999 Constitution as amended.
The court went on to say that refusing her bail would be a pre-trial ruling and an act of judicial misbehavior since it would be an improper use of discretion.
He also grounded the decision in Okoli's state of health. He postponed the hearing to June 13 in order to give it more time.
Okoli faces charges related to the remarks she made on tomato paste manufactured by Erisco Foods Limited on the internet, which the police claim breached the 2015 Cybercrime Act.
The Inspector-General (I-G) of Police arraigned her before Justice Lifu on two counts that had to do with cybercrime. She entered a not guilty plea on each allegation.
Mrs. Okoli was detained by the police in September 2023 after she wrote in a review that the tomato paste she had purchased from a market tasted sweet.
The Nagiko tomato mix paste that she mentioned in her evaluation is produced by Erisco Foods Limited in Lagos.
